Este proyecto busca analizar los desafíos asociados al litigio sobre cambio climático en América Latina, un tema que ha ganado relevancia a medida que los impactos del cambio climático se intensifican y las demandas para un mayor esfuerzo de mitigación y adaptación aumentan. La investigación se desarrollará desde una perspectiva jurídico-ambiental y social, con énfasis en el análisis de casos y legislaciones clave en la región, evaluando tanto los obstáculos como las oportunidades asociadas con este tipo de litigio. El objetivo general es analizar los desafíos legales, políticos y sociales asociados al litigio climático en Colombia, Argentina y Brasil. Más específicamente, el proyecto buscara no sólo analizar los marcos jurídicos en relación con el litigio climático en estos 3 países. Sino también Analizar los principales casos y formular recomendaciones para mejorar el equilibrio de los intereses económicos, los derechos humanos y la protección medioambiental. El proyecto adoptará una metodología de tipo cualitativa para recopilar y analizar datos. Se espera que el proyecto produzca una serie de resultados académicos y prácticos, y recomendaciones de políticas para mejorar el uso y la efectividad del litigio en el abordaje del cambio climático en la región. El proyecto tiene una gran relevancia social y académica. No solo contribuirá a llenar un vacío en la literatura existente, sino que también proporcionará información valiosa para formuladores de políticas, defensores del clima y partes interesadas, y ayudará a avanzar en la justicia climática. La justificación del proyecto radica en la creciente necesidad de comprender y fortalecer las estrategias legales en la lucha contra el cambio climático, un tema de crucial importancia para la sostenibilidad del planeta y el futuro de las generaciones venideras. Description This project seeks to analyse the challenges associated with climate change litigation in Latin America, a topic that has gained relevance as the impacts of climate change intensify and demands for greater mitigation and adaptation efforts increase. The research will be conducted from a legal-environmental and social perspective, with emphasis on the analysis of key cases and legislation in the region, evaluating both obstacles and opportunities related to this type of litigation. The main objective is to analyse the legal, political, and social challenges associated with climate litigation in Colombia, Argentina, and Brazil. More specifically, the project will not only examine the legal frameworks concerning climate litigation in these three countries but will also analyse the main cases and formulate recommendations to improve the balance between economic interests, human rights, and environmental protection. The project will adopt a qualitative methodology to gather and analyse data. It is expected to produce a series of academic and practical outcomes, as well as policy recommendations to enhance the use and effectiveness of litigation in addressing climate change in the region. This project is highly relevant both socially and academically. It will not only help fill a gap in the existing literature but will also provide valuable insights for policymakers, climate advocates, and stakeholders, thereby helping to advance climate justice. The justification for the project lies in the growing need to understand and strengthen legal strategies in the fight against climate change, an issue of crucial importance for planetary sustainability and the future of coming generations.
